Part I.

先click入僱傭天書重温勞工法例解僱的部份 (其實法例非常簡單), 再看看下列兩個個案,多些認識勞工署的一貫作風和反應:

個案一
我打過去勞工署hotline,用工人唔返嚟瞓嘅case問佢,佢第一個反應係:根據勞工法例,僱主係要provide地方俾工人瞓!我講咗幾次話唔係呢個問題,佢至話如果僱傭雙方之前講好幾点要返,而工人唔跟或者唔返,可以warn佢,我問佢唔聽我可以做乜,佢話補錢俾佢走,我話咁駛乜warn,佢都無言以對,話純粹睇僱主被claim (代通知金) 時個官点睇!重有,法例冇話夠幾多封warning可以炒得兼唔使賠,全完又係睇個官点睇!

個案二
話說「當年」我响一間約十幾人的 trading Co.做personnel,老闆之外有兩個「董事」,佢哋因為是早年幫手「開國」的「伙計」,所以老闆送股份俾佢哋之外,重幫佢哋手供樓,又俾Benz佢哋揸,可惜佢哋工作能力有限,未能與公司同步,自知工作上不能滿足老闆,竟然另起爐灶,兩個靜靜開公司搶客,某月的五号,他倆開始沒有返工,我才知這件事。
七日後,勞工署的電話便到了,老闆不在港,秘書小姐自然彈了給我,勞工署那人說公司欠他們四天人工! 我解釋他們是沒有通知離職的,我們都未追討代通知金,但勞工署就只說按法例規定,我們要七日內發薪……..,我說他們是公司董事,那人就說董事也是受薪的僱員,我不想跟那人糾纏,便說叫老闆打給他。
第二天,電話又來了,勞工署那人說那兩個「董事」要老闆到勞工署「商討」繳付欠薪,我說他們在「玩嘢」,唔會等嗰幾日人工開飯,但勞工署那人只重覆說,按法例規定…….
第三天,那人又再打電話來,又係嗰句,按法例規定……..問老闆何時去見,我當時火都嚟,便說:大佬,人哋係董事,有股份架,又搶公司的客,你用吓腦啦,邊個係受害人呀,車匙又未俾番,重有的股份,條數有排計,而家律師搞緊,你要揾自己揾個律師啦!跟住「給」線,咁先至冇再打嚟!

p.s. 你哋都可以試吓打個電話去勞工署,是但揾的野問吓,就會知個答案幾公式化,啲法例幾簡單!

 

Part II.

好啦!現在要明白以下的數個重点:

(1) 勞工署是幫勞工的,個工人点差都好,勞工署會覺得佢罪不至死,你可以随時炒佢,但你要補錢!
(2) 有很多僱主都被工人常常講電話、打爛嘢、駁咀、不聽指示、冇禮貌、黑面、夜返等等激到嘔血,但這一切,對唔住,都唔係死罪,就算佢簽哂認哂,如果事件本身不夠嚴重,一般公式化的warning letter 是沒有用的,即是出好多封也不會令你炒佢唔駛補錢,反之,出得愈多就愈令個官覺得反感,認為是「欲加之罪」,你只係想炒佢;此外,個官會覺得個工人因不太嚴重的事冇咗份工又冇錢係好慘,因此,啲工人如果做得出,僱主又沒有部署好,工人搏炒是win硬,搏得過的!
(3) 所以,關鍵就係: warning letter 其實唔係寫俾個工人睇的,係俾個官睇的,你一定要慘過佢,等個官同情我哋啲僱主,先至有機會! 慘過佢其實真係事實,弊在你好難將啲濕碎嘢擺埋一齊,表達俾個官知!
(4) warning letter之所以難寫,係因為要有好好的鋪排,由開始時的「提出」、「勸喻」,到備受滋擾、不奈煩、影響日常生活,全部都要表達得到出嚟,到最後一封信時,除了要清晰地指出傭工一樣嚴重的過失外,還要給勞工署知道僱主已經好忍讓 (一段時間)、好顧佢地嘅感受同利益、重好委屈,先至有「機會」(炒佢唔駛補錢)!

Part III. 点鋪排?

(1) 首先工人開工前要有一份手則,要注意唔可以太苛刻或者很難才做到的 (例如完全不准講電話);要給人有互相尊重的感覺,手則的字眼不能樣樣都「不准 XXX」,應多些用 please,即「請勿 XXX」。
(2) 當發現有小問題的時候,先用口頭提示和勸告,如好言問她為何不遵守某項協定,到她仍不大理時,就應該出第一封信。
(3) 第一封信是屬於勸喻式,不需要叫它做警告信,將情况、前因後果寫出,提示她要遵守之前的協定便夠了。
備註:(a) 假如工人黑面,我們可寫個 short note 給她,問她最近是否有什麼不開心,有什麽可以幫等! 習慣用 short note,要令她對black and white 減少介心 (記得留 copy,但不用叫她簽);這些 short note 也可用作獎勵,即用來讚她的,她也會happy些。
(b) 假如工人有什麼要求如借錢或攞假等,可以叫她將 request寫封短信給你,你再用 black and white 答佢,等大家習慣唔好淨用口講,一來真係減少口舌之爭,二來你同佢用信,可以有 record 你曾經 (或多次)滿足佢 (可能係不合理) 嘅要求!
例如短時間內多次打爛嘢也沒有要她賠!
(c) 很多僱主以為工人不肯簽警告信便冇符,事實並非如此,warning基本上唔需要僱員同意你warn 佢,因為他們不會同意(即唔認),即使簽咗認,佢都可以反口唔認,話你屈佢,所以,佢肯簽認錯或知道(acknowledge and confirm) 就最好,即要佢表示知道同明白你話緊佢啲乜嘢;唔簽的話,可以响佢簽收人工時加多一句:附上一封關於妳 XXX的信 (e.g. attached letter regarding your telephone calls),她簽收了信即可!(這樣做其實亦回應番之前我話不妨寫多些短信給她,俾個官知這你同佢一向都有溝通,不是一時之氣,淨係鬧或是口舌之爭。)
又比如佢打爛嘢,你寫落封信度講明今次唔駛佢賠,但下次要小心啲,佢一定拿拿聲同你簽,其實係想俾個官知你曾大方對佢!
之前有個工人整爛咗件電器,僱主想我幫佢寫封警告信,內容包括要保留追究權利;我沒有替他寫 (當時未有時間解釋),因為假如有日真係要見官,這封信對僱主來說肯定是minus而不是plus,原因係個官會覺得個工人用咁多嘢,必定會有整爛的機會,也有自然損耗,如果下下整爛嘢都被人保留追究權利,容セ易有日被人炒重要倒貼?咁封信就变成favour個工人!
(4) 如果沒有改善,可於兩至三星期後出第二封信,refer番第一封話睇唔到佢有改善,要忍辱負重,如果作出少少讓步就更好 (例如佢成日講電話,就索性劃一段時俾佢講;成日唔見人,夠鐘唔返,就隔幾日或一星期就劃一段free time俾佢),這些讓步當然要 black and white 簽番 (acknowledge) ,最緊要當然係寫得無奈的同慘的!

(5) 假如個工人簽哂收呢啲著數同讓步後有改善,可能問題已解決,或佢已經「聞到」燶味收斂咗,不用出第三封!順道一提,你不能在忍無可忍、要炒佢時才「翻轉頭」出這些信!信的timing很重要,永遠係早好過遲,一早就要部署!

(6) 如果個工人簽哂後重唔「見好即收」,以為你好恰,你又好想炒佢,便要靜候一個可以一擊即中的機會,因為雖然你手上亦已有一定注碼去預備第三封信,但沒有「重大過失」的事件出現,你仍然不能輕舉妄動!

(7) 如果出完第二封 (同一事件),沒有多大效用,或者好吓唔好吓咁,但又未有「重大過失」出現,你依然可以出多一封語氣較之前重的正式 warning,這次要表示沒法再讓步,如無改善,我會沒有選擇,只得考慮揾過個更合適的人;而期間,如果工人有另一些過失 (即並非同一事件),你也可以上述的方式出信同佢講!

(8) 所謂「重大過失」,舉個例:有BK Mom叫咗工人唔好自己帶bb去街,去買餸都要放bb去奶奶道先,但佢照去,重俾朋友撞見,出咗兩封信話佢,基本上唔知重有冇去,如果能夠有一次捉到佢同bb去街重真係有意外,有損傷 (要報警驗傷) 便可即炒,這個情況才搏得過!調轉如果這意外沒有之前的幾封信做 back up,勞工署九成都仍要佢俾代通知金,因為佢證明唔到不是初犯!

 

Part IV. 而家輪到一些例子,要一提的是,如果你哋不是完全明白信 (或段、句) 的內容,千萬不要照搬:
例子 (1) – 工人態度惡劣,叫你炒佢
Dear XXX
Recently, my wife said that there were a number of times last week you asked her to terminate your service.
I don’t understand why you keep on asking us to terminate you. You must know that we will have to wait for two and a half months for a new helper to come and we have to teach the new helper everything all over again wasting a lot of time. Unless you have problems and have to rush back to your country, I don’t see why you want us to terminate you.
If you have any personal problem, please do not hesitate to let us know as we are always willing to help. However, if your finally decision is to leave us, please tender your resignation and give us one month notice so that we can start to find a replacement as soon as possible.

解讀:這封信是以退為進,講出係佢叫僱主炒佢,僱主亦願意幫佢解決問題,因為揾過另一人會好煩!而信亦隱晦地講出係個工人可能有problem要solved,唔係僱主嘅問題!

例子 (2) – 成日講電話

Re : Rules for domestic helper

Reference is made to the above list of rules which you agreed to observe on the day you commenced to work here.

Recently, we found that you were talking on the phone frequently for quite a long time during working hours; and we wonder if you could take good care of our baby while talking to your friends on the phone. We know that you will have some free time when the baby is sleeping in the afternoon, but if your mobile phone is always on, you cannot stop your friends calling you up.

We also know that a domestic helper’s job is not a challenging one and you may feel bored and want to talk to your friends. In order that you can take good care of the baby, we strongly request that you use the phone only when we come back from work and you should turn off your mobile phone during your working hours especially when we’re not home.

Your attention to this matter is highly appreciated.

解讀:這算是第一封warning,你會睇倒我故意講出僱主係明白佢要講電話,亦會俾時間佢講,只係担心佢因為要接電話而顧不到BB。假如冇improvement ,可在兩至三星期內出第二封語氣較重的…….

Dear XX

Further to our letter dated _______ requesting you to turn off your mobile phone during working hours so that you will not be disturbed by your friends’ calls when you are taking care of our baby, we are sorry that we did not see any improvements on this till now. (最好可講埋事發經過,例如婆婆無意中見到好幾次)

You must know that the two of us do not need a helper if not because of the baby, and we rely totally on you to take care of her/him while we are not home. If we have to be worried all the time about her/his safety while we are working, what’s the purpose of hiring you ?

Therefore, please observe the rules which we mutually agreed, and turn off your mobile phone until we come home from work !

解讀:假如沒有發生事故,例如講電話引致小朋友受傷等,最多只能出多一封,但若真的有事發生時距離這封信的時間太遠,會令人覺得這段時間她做得 OK,所以如果你忍唔到,時間上又等唔到,就索性補錢炒佢唔駛煩!
